Terms of Service & License Agreement

Welcome to Eyelykit Studio. By accessing our website, purchasing memberships, or downloading our digital graphics, templates, animations, and AI prompts (“Products”), or hiring us for custom design services, you agree to be bound by the following Terms of Service (“Terms”).

1. License and Usage Rights

Upon purchase or membership download, Eyelykit Studio grants you a perpetual, non-exclusive, non-transferable commercial license to use the Products, subject to the following conditions:

Permitted Uses:

• Creating final end-products for your photo booth rental clients, such as event overlays, virtual backdrops, and digital activations.
• Modifying and editing the assets to fit your specific event needs or client branding.
• Incorporating the assets into your own marketing materials, website, and social media to promote your photo booth business.
• Charging your clients for the customization of these designs for their specific events.

Prohibited Uses:

• Reselling, redistributing, gifting, or sharing the layered templates, derivative designs, AI prompts, or individual graphics as standalone files.
• Extracting individual elements or graphics from our templates to create new files for distribution.
• Using the assets to create a competing product or service.
• Claiming the original unedited assets as your own work or attempting to trademark them.

2. Memberships and Account Security

If you purchase a membership (including Lifetime Memberships), your account is strictly for your own business use. You are responsible for maintaining the confidentiality of your account login information. Account sharing is strictly prohibited. We actively monitor accounts for suspicious download activity and IP sharing. If we determine a membership is being illegally shared, distributed, or abused, we reserve the right to suspend or terminate the account immediately without a refund.

3. Software Compatibility and AI Prompts

Software Assets: Our templates, graphics, and animations are designed for various major photo booth software platforms. It is the purchaser’s responsibility to verify compatibility with their specific software before purchase. We are not responsible for software updates by third-party companies that may alter the functionality of our assets.

AI Prompts: Due to the evolving nature of artificial intelligence platforms, we cannot guarantee exact replication of results when using our AI prompts. Image generation is subject to the algorithms of third-party platforms, which may change without notice.

4. Custom Orders and Design Services

For custom orders, website design, and logo design services, specific deliverables, timelines, and revision limits will be agreed upon prior to the start of the project. Once final approval is given and files are delivered, any further changes will incur additional fees.

5. Payment, Delivery, and Strict No-Refund Policy

Digital Goods Exemption: Due to the immediate, irrevocable access to digital products upon purchase, all sales of digital downloads, templates, animations, AI prompts, and memberships are strictly final. By completing a purchase and downloading the digital assets, you explicitly acknowledge and agree that you waive any applicable consumer “cooling-off” period or right of withdrawal.

No Refunds or Exchanges: We do not offer refunds, returns, exchanges, or store credit for any digital products under any circumstances. It is the sole responsibility of the purchaser to thoroughly read the product descriptions, verify software compatibility, and ensure the product meets their specific needs prior to completing the transaction.

Legally Binding Agreement and Chargebacks: This strict no-refund policy is a legally binding condition of sale. Any unauthorized credit card chargebacks or payment disputes filed after you have accessed or downloaded our digital assets will be considered a breach of these Terms and potential digital theft. In the event of an unwarranted chargeback, we reserve the right to immediately terminate your account, revoke your commercial license to use any previously downloaded assets, and submit this agreement and download logs to your financial institution to recover the disputed funds.

Technical File Issues: If you experience a verified technical issue, such as a corrupted file or a broken download link, you must contact our support team within 7 days of purchase. We will gladly provide a replacement of the exact same file or fix the download link, but technical difficulties do not constitute grounds for a refund.

6. Intellectual Property

All intellectual property rights in the original Products remain the property of Eyelykit Studio. You do not acquire ownership rights by purchasing a license to use them.

7. Limitation of Liability

The Products are provided “as is” without any warranties, express or implied. To the fullest extent permitted by law, Eyelykit Studio shall not be liable for any indirect, incidental, special, or consequential damages, lost profits, or business interruption resulting from your use or inability to use the Products or services.

8. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of Alberta, Canada. Any disputes arising out of these Terms or the use of the Products shall be resolved exclusively through binding arbitration in Alberta, Canada.

9. Changes to Terms

We reserve the right to modify these Terms at any time. Material changes will be communicated via our website. Your continued use of the site and Products after changes have been posted constitutes your acceptance of the revised Terms.
