Navigating the Digital Landscape with Eyelykit Studios

1. Definitions
- For purposes of these Terms of Service:
- “Digital Media Files” are any images, animations, films, videos, or other audio/visual representations recorded in any computer-readable format or form that are obtained, directly or indirectly, from Eyelykit Studio.
- “Intellectual Property Rights” shall mean all rights of authorship, all copyrights (including rights in applications or registrations), all rights of attribution and integrity and other moral rights, all rights of inventorship, all rights in patents and patent applications, all trademark rights (including rights in applications or registrations), all rights in trade secret and proprietary information, and all other intellectual property rights of any type, whether registered or registerable or not in any country.
- “Purchase Price” means the purchase price, membership fee, or pricing structure Licensee selected or will select during Licensee’s enrollment process for use of the Eyelykit Studio Products.
2. Grant of License
- The Licensee may use the Digital Content in their photo booth(s) for events, parties, and other occasions where photo booth services are provided.
- The Licensee may modify the Digital Content to suit their specific needs and branding for use in their photo booth operations.
3. Prohibited Uses:
- The Licensee may not resell, sublicense, distribute, or otherwise make the Digital Content available to third parties in a manner that competes with the business of the Licensor.
- The Licensee may not use the Digital Content in a way that violates any applicable laws or infringes upon the rights of third parties
4. Ownership:
- he Licensee may not reverse engineer, decompile, or disassemble the Digital Content.
- The Licensee may not use the Digital Content for any illegal or unauthorized purpose
5. Restrictions:

6. Updates and Support:
- Licensor may, at its discretion, provide updates or support for the Digital Content. Such updates or support may be subject to additional fees or terms.
7. Payment and Refunds:
- All payments for Digital Content are non-refundable. Licensor is not responsible for any issues arising from the Licensee’s inability to use the Digital Content, except where such issues result from defects in the Digital Content provided by Licensor.
8. Termination:
- This license is effective until terminated by either party. Licensor may terminate this license immediately and without notice if the Licensee breaches any terms herein.
Templates files and the artwork contained within is for limited commercial use by the purchaser and/or his employees. Files may be edited and used by you or your company employees for the sole purpose of web or print marketing, client proofing and distributing photo imagery from your photo booth(s) to your clients and/or their guests. You may charge your photo booth rental clients for the use and customization of the designs for their events. Graphics and artwork may not be extracted from templates and used in other files. However you may edit the file and add your own artwork to any template to make it unique. Templates and artwork may only be distributed to your rental clients and their guests or consumers via printed materials or in a flattened digital format. Layered Template Files, derivative designs and individual graphics and/or artwork elements contained within the files may not be shared, redistributed, gifted or sold to another party. You may not purchase designs and use them to provide custom designs to anyone other than your own photo booth rental customers. All lifetime members will also be monitored via IP address monitoring for illegal sharing of the membership and may be suspended until further investigation is complete.
